General Terms and Conditions WONDERSTRIPES Cosmetics GmbH

WONDERSTRIPES is registered as an industrial design and as a word/figurative mark and enjoys all the associated property rights!

The following Terms and Conditions shall apply to any and all contracts, deliveries and services by and between WONDERSTRIPES Cosmetics GmbH (hereinafter also referred to as: „we“, „us“) and our customers (hereinafter also referred to as: „you“, „your“).

1. Conclusion of contract

Your order is considered an offer to enter into an agreement for sale with WONDERSTRIPES Cosmetics GmbH. In case you place an order with WONDERSTRIPES Cosmetics GmbH, we sent you an E-Mail confirming your order (order confirmation). This order confirmation shall inform you that your order has been received, but shall not, however, constitute an acceptance of your offer. The agreement for sale shall be concluded once we have arranged delivery of the ordered goods and the dispatch has been confirmed by way of sending a second E-Mail (confirmation of dispatch).

2. Instructions on withdrawal

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day ‘on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the good without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

3 . Exclusion and/or Termination of the right of withdrawal

The right to withdrawal as stipulated in Section 312g subsection (2) BGB is – among other things - excluded in case of contracts for the delivery of goods which are not been pre-build and for which their manufacture an individual choice or decision by the consumer is important or which are clearly tailored to the personal needs of the consumer and it expires prematurely in case of contracts for the supply of sealed goods which are unsuitable to return for reasons of health or hygiene when their unsealed upon delivery.

Any and all prices declared on the websites of WONDERSTRIPES Cosmetics GmbH are subject to change and include value added tax (VAT). We review the pricing when we process your order. In the unlikely event that the product is tagged with a false price and the correct price is higher than the price on the website, we will contact you before shipping the goods to ask you if you purchase the product at the correct price or want to cancel the order.

5. Warranty

The statutory warranty period is two years. The period begins with delivery of the goods. For any and all defects to occur during the statutory warranty period, the statutory claims for cure, rectification of defects/ redelivery apply at your discretion and – provided the further statutory requirements are met - the further claims of the reduction of price or revoke the contract as well as damages, including the compensation of the damage of performance as well as demand reimbursement of futile expenditure

We deliver available goods within Europe usually within 3-7 business days to the shipping address provided by you. If an item is not available or not within 3-7 business days, we will inform you as soon as possible with the delivery date. If a particular item is not available, we undertake to inform you about the unavailability before accepting your order. We point out that all information on availability, shipment or delivery of a product are only estimated times and approximate values. They are not mandatory or guaranteed shipping or delivery dates, unless this is expressly stated in the shipping options of the individual product as a binding deadline.

Delivery is exclusively carried out made by mail with Deutsche Post or DHL. For delivery and packaging costs, we charge the following costs: Shipping Information.

8. Payment

Payments can be made by bank transfer, credit card, PayPal, or advance payment. However, we reserve the right on every order, not to offer certain payment methods and to refer to other forms of payment. If the place of residence is outside Germany, payments are possible by credit card, Paypal (for further information about the countries in which the payment by Paypal is possible please visit: www.paypal.com) or cash in advance via bank transfer.

9. Retention of title

WONDERSTRIPES Cosmetics GmbH shall retain all title until full payment is made.

10. Liability

WONDERSTRIPES Cosmetics GmbH is liable without limitation for all damages caused by intentional or grossly negligent conduct by WONDERSTRIPES Cosmetics GmbH and/or a legal representative or vicarious agent of WONDERSTRIPES Cosmetics GmbH. Furthermore WONDERSTRIPES Cosmetics GmbH is liable for the negligent breach of material obligations whose violation endangers the purpose of the contract, or for breach of obligations which allow the fulfillment of the execution of the contract in the first place and upon whose adherence you routinely rely. In this case, however, WONDERSTRIPES Cosmetics GmbH is only liable for the foreseeable, typical damage. WONDERSTRIPES Cosmetics GmbH liable not for the negligent breach other than those obligations mentioned in the preceding sentences.

The preceding limitations of liability shall not apply for losses arising from death, injury to body and health, for damages after the acceptance of a guarantee for the condition of a product and for defects intentionally misrepresented by silence. Liability according to the Product Liability Act shall remain unaffected.

As far as the liability of WONDERSTRIPES Cosmetics GmbH is excluded or limited, this shall also apply for the personal liability of employees, representatives and vicarious agents.

11. Data privacy
By ordering you agree that WONDERSTRIPES stores your personal data contained in the order, processed and used in the context of the customer relationship. Even if you have not signed up for the newsletter, we will occasionally use your email address to send you current promotions and offers. 12. Copyright and intellectual property rights

The content of the websites operated by WONDERSTRIPES Cosmetics GmbH are subject to German copyright and / or other intellectual property rights. The reproduction, modification, distribution or any other use of content requires the prior written consent of WONDERSTRIPES Cosmetics GmbH. As far as the content is not created by the website operator, the copyrights of third parties will be considered. Such content will be identified. Should you nevertheless become aware of copyright infringement, we kindly ask for a note. Upon such notification of violations, we will remove such content immediately.

13. Miscellaneous

German law shall apply to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (CISG). Unless required otherwise mandatory by law, the courts of Hamburg, Germany shall have exclusive jurisdiction.

You agree to receive contract related communication electronically. Necessary data for the transaction will be stored. All personal data is handled confidentially. Your data privacy concerns are taken very seriously. In addition, our data protection declaration shall apply.

WONDERTSRIPES Cosmetics GmbH reserves the right to amend or make changes to the online shop and the Terms and Conditions at the sole discretion. On your order the terms and conditions in force at the moment of your order shall apply unless a change to these terms and conditions is required by law and/pr administrative order (in this case they also apply on your prior orders). If any provision in these terms and conditions is or become invalid, void or for any reason unenforceable, these rules shall be deemed severable and not affect the validity and enforceability of the remaining provisions.
